FISA example highlights amendment concerns
A March 2026 report stated that FBI searches of Americans’ data collected under FISA Section 702 increased during 2025, from 5,518 to 7,413 searches. Privacy advocates cited the increase as evidence of continuing access to communications involving Americans without traditional warrants.
A US federal court had ruled in January 2025 that the FBI violated the Fourth Amendment when it searched Section 702 communications using identifiers associated with US person Agron Hasbajrami without first obtaining a warrant. The case illustrates how communications acquired for foreign-intelligence purposes can later be searched for domestic investigative use.

Microsoft acknowledges EU data-access risks
During a French Senate inquiry into digital sovereignty, Microsoft France’s Director of Public and Legal Affairs was asked whether Microsoft could guarantee that French citizens’ data would never be supplied to US authorities without French government approval. He said that he could not provide that guarantee.
The hearing examined how US laws, including the CLOUD Act, can compel US companies to disclose data regardless of where it is physically stored. The exchange matters because it connected jurisdictional risk to sensitive European public-sector and health information in a formal public hearing.
